Danielle was referred by the Magistrate’ Court after having been served with and intervention order application made by her ex-partner, Stan. Danielle had an intervention order in place against Stan since previously, however in South Australia. Over the past decade numerous intervention orders have been in place against Stan, whilst Danielle and Stan were on and off in a relationship.
The current Victorian application by Stan included serious allegations including alleged threats of use of weapons by Danielle and at the first mention Stan sought an interim order. BGCLS advocated against this based on the series of previous orders that had been in place for the protection of Danielle, as well as the current order and because Stan was continuously breaching the current order against him. Evidence was tendered at the first mention in support of why the application for an interim order ought to be rejected. The matter was ultimately adjourned without an interim order and Stan was ordered to provide a summary of evidence before the next hearing.
Being so removed from the Court where her matter was listed, Danielle was experiencing significant stress. She also felt that even though she did not want any further contact with him, she also did not want to have an order against her as she continued to receive calls and text messages from Stan. Despite these contacts not being threatening in nature it made her feel fearful due to his history and the allegations now made against herself. As a result of these factors a case was opened to provide her with ongoing assistance between the hearing dates, to assist her with collection of the summary of evidence and to respond to the evidence.
At the next hearing Stan ultimately withdrew his application against Danielle. She still has an intervention order in place against Stan for her protection.
